1. Who we are

These Terms & Conditions apply to all orders placed through the online shop of:

In these Terms, “we”, “us” or “Maison Kame” refers to the shop operator. “You” or “customer” refers to the person placing an order.

By placing an order in our online shop, you agree to these Terms & Conditions.

2. Scope

  • These Terms & Conditions apply to all purchases made via our online shop at https://maisonkame.com.
  • Any different terms proposed by you do not apply unless we have agreed to them in writing.

3. Ordering process & contract

  1. The products shown in the shop are not a binding offer. They are an invitation to place an order.
  2. You place a binding order by going through the checkout and clicking the “Pay now” / “Complete order” button.
  3. After you place an order, you will receive an automatic order confirmation email. This confirms that we received your order, but it is not yet the final acceptance.
  4. The purchase contract is concluded when:
    • we send a separate shipping confirmation email, or
    • we dispatch the goods.
  5. We may decline an order in justified cases, for example:
    • if products are unavailable,
    • if payment is not successful,
    • in case of suspected misuse or fraud.

4. Prices, currency & shipping costs

  1. All prices in the shop are shown in Swiss Francs (CHF) and include applicable VAT, where required by law.
  2. Shipping costs are not included in the product price.
    They are shown separately during checkout before you complete your order.
  3. For deliveries outside Switzerland, and where applicable outside the EU, additional customs duties, taxes or fees may apply.
    These are charged by the destination country’s authorities and are your responsibility.
  4. We may change prices at any time. The price valid at the time of your order applies.

5. Payment

  1. Payment is made via the methods offered in our Shopify checkout, for example:
    • Credit or debit card
    • PayPal
    • TWINT
    • Shopify Payments
      (Available options may vary by country.)
  2. By choosing a payment method, you authorise the payment provider to charge the amount of your order.
  3. For card payments, your card is usually charged immediately when the order is placed.
  4. We reserve the right to exclude certain payment methods for individual orders or to deliver only against prepayment.

6. Shipping & delivery

  1. We ship from Switzerland to the countries shown during checkout (for example Switzerland, EU countries and other destinations where offered).
  2. Orders are shipped to the delivery address provided during checkout. Please make sure your address is correct and complete.
  3. Estimated delivery times are shown in the product or during checkout. These are guidelines, not guaranteed delivery dates.
  4. If a product is no longer available after you place an order, we will inform you as soon as possible and refund any payments for that product.
  5. If a parcel cannot be delivered due to incorrect address details, refusal to accept or non-collection, additional costs (for example reshipping) may be charged to you.

7. Retention of title

The goods remain our property until full payment has been received.

8. Returns, withdrawal & exchanges

8.1 Voluntary return policy

For certain orders we may grant a voluntary return period of 14 days from the day you receive the goods, under these conditions:

  • The products are unused, unopened and in their original packaging.
  • The products are in resellable condition.

Excluded from this voluntary return policy are in particular:

  • Opened or used products such as incense, candles, sprays, soaps, oils or cosmetics
  • Customised or personalised products
  • Digital products or downloads
  • Gift cards (if offered)

Return shipping costs are usually paid by you, unless we have made a mistake (for example wrong or damaged item).

After we receive and check your return, we refund the product price via the original payment method. Shipping costs are usually not refunded.

Details of whether and how a voluntary return option applies to your order are set out on the relevant product pages or during checkout.

If you live in a country with a legal right of withdrawal for online purchases, the statutory rules of your country of residence apply.

In this case, you may have a statutory withdrawal period and special conditions. These statutory rights apply in addition to any voluntary return policy described here.

9. Vouchers, discount codes & promotions

  1. Vouchers and discount codes can only be used under the conditions communicated with them (for example minimum order value, validity period).
  2. Unless stated otherwise:
    • Only one discount code can be used per order.
    • Vouchers and discount codes are not paid out in cash.
    • They are not applied retroactively to previous orders.
  3. If you return items from an order where a voucher or discount code was used, the refund is limited to the amount you actually paid (not including the voucher value).

10. Product details, colours & handcrafted nature

  1. We aim to describe and photograph our products as accurately as possible.
  2. Please note:
    • Colours may appear slightly different on different screens.
    • Many of our products are handcrafted or made from natural materials, which means:
      • small variations in colour, texture, shape or size are normal
      • such variations are part of the character of the product and do not constitute defects.

11. Defects, warranty & liability

  1. Please check your order as soon as you receive it.
    If something is damaged, missing or incorrect, contact us as quickly as possible at: info@maisonkame.com.
  2. In case of a justified defect, we will, at our discretion:
    • replace the product, or
    • refund the purchase price for the defective item.
  3. Our liability is limited as follows:
    • We are liable without limitation in cases of intent, gross negligence and for injury to life, body or health.
    • In cases of slight negligence, we are only liable for the breach of essential contractual obligations (so-called cardinal obligations). In such cases, liability is limited to the foreseeable, typical damage.
  4. Mandatory legal liability rules (for example product liability laws) remain unaffected.

12. Use of the website & intellectual property

  1. All content on https://maisonkame.com – including text, images, graphics, logos, product designs and layouts – is protected by copyright or other intellectual property rights.
  2. You may use the website and content only for personal, non-commercial purposes in connection with browsing and shopping.
  3. Any copying, distribution, editing or other use beyond normal shopping and browsing requires our prior written consent.
  4. The Maison Kame name, logo and any related marks may not be used without our permission.

13. Privacy & data protection

  1. We handle your personal data in line with applicable data protection laws.
  2. Details on how we collect, use and protect your data can be found in our Privacy Policy, available on our website under “Privacy Policy”.
  3. Our online shop runs on the Shopify platform. Data may therefore be processed by Shopify and its service providers.
  4. We also use web analytics and SEO tools, such as Google Search Console and similar services, to monitor and improve the performance, search visibility and technical stability of our website. These services are provided by third parties and may process technical data as described in our Privacy Policy.

14. Applicable law & place of jurisdiction

  1. Unless mandatory consumer protection rules of your country say otherwise, these Terms & Conditions and all contracts are governed by the laws of Switzerland, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. Where legally permitted, the place of jurisdiction for all disputes arising out of or in connection with these Terms & Conditions or your order is St. Gallen, Switzerland.

15. Changes to these Terms

  1. We may update these Terms & Conditions from time to time.
  2. The version that applies to your order is the one available on our website at the time of your order.
  3. If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by the applicable legal rule.
